Terms of Use and Data Policy
Welcome to Streetshot!
These Terms of Use govern your use of Streetshot and provide information about the Streetshot service, outlined below. When you create a Streetshot account or use Streetshot, you agree to these terms.
The Streetshot Service
We agree to provide you with the Streetshot service. The Service includes all of the Streetshot products, features, applications, services, technologies, and software that we provide to advance Streetshot's mission: To help your find the best street art, pop-up events and local business offers (the Service):
- Find all the street art and pop-up events in your area and connect with the artists. We will provide your with the locations of the all the best street art in the area you are searching (if available in our database). Users will be able to share their art with other users by posting online. Professional and non-professional street artists can share up-to-date locations and art with others. Users are also able to post pop-up events online for others to discover. Streetshot will also allow you to connect with local businesses through special daily offers. Thus helping the local community to thrive. Upgrading of accounts can be done for free by watching a reward video provided by AdMob (this may become a subscription service in the future).
- Fostering a positive, inclusive, and safe environment. Streetshot provides and a safe and secure environment in which to share art and events. We will endeavour to remove any posts that are negative in nature, are not inclusive and/or aim to cause harm. Posts can be reported and Streetshot will then review these posts. Violations will result in removal of the post and the account may be terminated. We also may share information about misuse or harmful content with law enforcement. - Developing and using technologies that help us consistently serve our growing community. Organizing and analysing information for our growing community is central to our Service. A big part of our Service is creating and using cutting-edge technologies that help us personalize, protect, and improve our Service on an incredibly large-scale for a broad global community. Technologies like artificial intelligence and machine learning give us the power to apply complex processes across our Service. Automated technologies also help us ensure the functionality and integrity of our Service.
- Ensuring a stable global infrastructure for our Service. To provide our global Service, we must store and transfer data across our systems around the world, including outside of your country of residence. This infrastructure is currently owned or operated by Google Firebase.
- Connecting you with brands, products, and services in ways you care about. We use provide ads via Google’s AdMob, in order to try to keep the platform free to use. You can go Ad-Free for a small fee, and we may move to a subscription model for events and buisnesses in the future.
- Research and innovation. We use the information we have to study our Service and collaborate with others on research to make our Service better and contribute to the well-being of our community.
The Data Policy
Your Commitments
In return for our commitment to provide the Service, we require you to make the below commitments to us.
Who Can Use Streetshot. We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. So, we need you to commit to a few restrictions in order to be part of the Streetshot community.
- You must not be prohibited from receiving any aspect of our Service under applicable laws or engaging in payments related Services if you are on an applicable denied party listing.
- You must be at least 16 years old.
- We must not have previously disabled your account for violation of law or any of our policies.
- You must not be a convicted sex offender.
How You Can't Use Streetshot.
Providing a safe and open Service for our broad community requires that we all do our bit.
- You can not impersonate others or provide inaccurate information, which may or may not cause harm and distress.
- You do not have to disclose your identity on Streetshot but you must provide us with accurate and up to date information (including registration/email information). Also, you can not impersonate someone you are not, and you can not create an account for someone else unless you have their express permission.
- You can not do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose. Unlawful activities may be flagged to the law enforcement officers.
- You can not violate (or help or encourage others to violate) these Terms or our policies.
- You can't do anything to interfere with or impair the intended operation of the Service.
- You can not attempt to create accounts or access or collect information in unauthorized ways. This includes creating accounts or collecting information in an automated way without our express permission.
- You can not attempt to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges/photos of other users.
- You can not post private or confidential information or do anything that violates someone else's rights, including intellectual property..
- You can not use a domain name or URL in your username without our prior written consent.
Permissions You Give to Us.
As part of our agreement, you also give us permissions that we need to provide the Service.
- We do not claim ownership of your content, but you grant us a license to use it. We do not claim ownership of your content that you post on or through the Service. Instead, when you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Service, you hereby grant/give to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). You can end this license anytime by deleting your content or account. However, content will continue to appear if you shared it with others and they have not deleted it.
- Permission to use your username, profile picture, and information about your relationships and actions with accounts, ads, and sponsored content. You grant us permission to show your username, profile picture, and information about your actions (such as likes) or relationships (such as follows) next to or in connection with accounts, ads, offers, and other sponsored or non-sponsored content that you follow or engage with that are displayed on Steetshot Products, without any compensation to you. For example, we may show that you liked a sponsored post created by a brand that has displayed (paid or otherwise) its ads on Streetshot. As with actions on other content and follows of other accounts, actions on sponsored (or non-sponspored) content and follows of sponsored accounts can be seen only by people who have permission to see that content or follow.
- You agree that we can download and install updates to the Service on your device.
Additional Rights We Retain
- We can stop providing the Service in-part or as a whole, at any time if we need to. We will endeavour to continue to provide the service for as long as we can. However, if we need to stop the service this could happen without prior notification to you. We can also transfer the Service to another provider in the future without prior notification to you.
- Downloading and installing this Service/application (whether you paid for the application/subscription or not) will mean you have the right to use the application (if you agree to the Terms of Use as stated here) whilst the Service is still available. We retain the right to terminate the Service or transfer it to another entity without prior notification to you, and you do not have the right to a refund (although we will try to notify you if the Service/Application is due to be terminated/end or transferred to another company)
- If you have paid for the app or for in-app purchases, this gives you the right to download the application and install it. If the Service/application is terminated, you do not have a right to a refund.
- If you select a username or similar identifier for your account, we may change it if we believe it is appropriate or necessary (for example, if it infringes someone's intellectual property or impersonates another user or it is offensive).
- If you use content covered by intellectual property rights that we have and make available in our Service (for example, images, logos, designs, videos, or sounds we provide that you add to content you create or share), we retain all rights to our content (but not yours).
- You can only use our intellectual property and trademarks or similar marks with our prior written permission.
- You must obtain written permission from us or under an open source license to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
Content Removal and Disabling or Terminating Your Account
- We can remove any (or all) content or information you share on the Service if we believe that it violates these Terms of Use, our policies, or we are required to do so by law. We can refuse to provide or stop providing all or part of the Service to you (including terminating or disabling your account) immediately if you: clearly, seriously or repeatedly violate these Terms of Use, our policies, if you repeatedly infringe other people's intellectual property rights, or where we are required to do so by law. If we take action to remove your content for violating our Terms of Use, or disable or terminate your account, we will notify you where appropriate. If you believe your account has been terminated in error, or you want to disable or permanently delete your account, please contact us.
- Content you delete may still persist for a limited period of time in backup copies and it will still be visible where others have shared it.
- Violation of copyright law, or law of the country in which you uploaded the content or in which you reside, will result in removal of content and/or termination of your account.
- We reserve the right to completely terminate the whole service if any circumstances outside our control occur - such as instructed by the law, transfer of the Service to another entity, for financial reasons.
Updating These Terms
We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will update the Terms of Use here and also in any new downloads of the application. Then, if you continue to use the Service, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you can delete your account.
Data Policy
This policy describes the information we process to support Streetshot.
I. What kinds of information do we collect?
To provide the Streetshot products, we must process information about you. Things you and others do and provide.
- Information and content you provide. We collect information when you sign up which is your email address and username. When you post material, we collect the photos, the time of uploading, locations of photos, and your username. If you communicate inside the app such as post comments, like photos, post hashtags, follow and unfollow other users, all these data is also collected. In order to do this we ask permission to access your GPS, your camera and photo library. If you are a professional artist, business or pop-up event organiser, extra information about the content is stored which is provided by you when you fill out the posting details – such as time, dates, descriptions, offers and types of events. All such data and content is stored securely on the Firebase database.
- Networks and connections. We collect the make and model of your device. We also collect the country in which you are using the app. This is done in order to improve the application.
- Your usage. We analyse how which parts of the app you use the most and also crash data from the application, this is done via Firebase, and this is done in order to improve the application.
- Device Information We collect the make and model of your device. We also collection the country in which you are using the app. This is done in order to improve the application.
- Information from partners. Streetshot uses Google AdMob, to provide in-app adverts, this makes it possible for the app to stay free. We may change this in the future.
II. How do we use this information?
The information we collect is primarily used to provide the services in the app. We may provide your username and email addresses to our partners who may contact you directly with information of offers and events. You can opt out of this feature in your "Profile" page under the Help/FAQ section. Please note the default setting is set to "Opt-in".
Provide, personalize and improve our Products.
- Location-related information: We collect your location information so that you can post photos tagged with a location. We also need your location so that we can show street art, pop-up events and businesses on the map near your current location. The adverts presented within the app will also your your location to provide you with location relevant advertising.
- Product research and development: We use the crash information, location data and how you use the app in order to improve it.
Promote safety, integrity and security.
We use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of our Products, and promote safety and security on and off Streetshot products.
Communicate with you.
We use the information we have to send you marketing communications, communicate with you about our Products, and let you know about our policies and terms. We also use your information to respond to you when you contact us.
III. How is this information shared?
Your information is shared with others in the following ways:
We use the application platform to deliver adverts via AdMob, we thus share your usage of the application with AdMob. We may use your contact details (username and email address) with third party partners to provide you with other information and offers.
Illegal activity may be shared with law enforcement, if required to do so.
V. What is our legal basis for processing data?
We collect, use and share the data that we have in the ways described above:
- as necessary to fulfil our Streetshot terms of service
- consistent with your consent, which you may revoke at any time through deleting the application
- as necessary to comply with our legal obligations
- to protect your vital interests, or those of others;
- as necessary in the public interest; and
- as necessary for our (or others') legitimate interests, including our interests in providing an innovative, personalized, safe, and profitable service to our users and partners, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data.
VI. How can you exercise your rights provided under the GDPR?
Under the General Data Protection Regulation, you have the right to access, rectify, port and erase your data. Please contact us if you wish to delete or alter your posts, comments, and/or account.
VII. Data retention, account deactivation and deletion
We store data until it is no longer necessary to provide our services, or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs. When you delete your account, we delete things you have posted, such as your photos and status updates, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted.
VIII. How do we respond to legal requests or prevent harm?
We access, preserve and share your information with regulators, law enforcement or others:
- In response to a legal request, if we have a good-faith belief that the law requires us to do so. We will follow the law in good faith and as such we may use this to help detect and prevent and address fraud, unauthorized use of the products, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or Products), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm. For example, if relevant, we provide information to and receive information from third-parties about the reliability of your account to prevent fraud, abuse and other harmful activity on and off our Products.
IX. How do we operate and transfer data as part of our global services?
- The backend database is run by Firebase and all information is stored securely. Firebase is a GDPR complaint backend.
X. How will we notify you of changes to this policy?
- We'll notify you before we make changes to this policy and give you the opportunity to review the revised policy before you choose to continue using our Products.
